This Privacy Policy applies only to personal data that we collect on the website www.bampooh.com (the “Site”) as it may be modified, relocated and/or redirected from time to time. Personal data means information that relates to you as an individually identifiable person, such as your name, e-mail address, and mobile number.
Accordingly, this Privacy Policy does not apply to information collected by anyone other than us (even if related to our business), information collected other than via the Site, and non-personally identifiable information, which, standing alone, cannot be used to determine your identity.
WHAT PERSONAL DATA WE COLLECT
Information You Give Us
We collect personal data that you voluntarily share with us through the Site. For example, we collect information from you when you create an account, make a purchase or fill out a request form on the Site.
The personal data we collect from you may include, without limitation:
- Contact information, including name, address, email address, and telephone number.
- Messages you send to Bampooh, for example, a product inquiry that may contain information such as order numbers, requests for return merchandise authorization (RMA), vehicle identification number (VIN) and other information.
- Personal information collected by electronic surveys that Bampooh Directive conducts (for example a contest entry or after purchase satisfaction survey). Surveys may expressly ask you for your personal details so we can provide additional information or follow up.
- Data (some of which may be personal data) collected by automated means when you call our customer service center. For instance, we may record audio of these calls for quality control and training purposes.
We also collect certain information which may include personal data when you submit (a) order information, including name, company name, product information, and delivery address; and (b) payment information, including billing address, credit card number, expiration date, and CVV into the Site (this information is transmitted via Transport Layer Security (TLS) encryption to a third-party order and payment processor and is not stored on Bampooh severs).
Information We Collect Through Technology on The Site
We may collect and store information through various technologies when you access the Site. Some of the information we collect and store and the technologies we use to do so are discussed below.
General Use and Preference Information
When you visit the Site, we may collect and store information regarding your use of the Site, such as details of how and when you used the Site, your interactions on the Site (including resources and pages that you access), your location, your device identifier and type, your browser information, and your Internet Protocol (IP) address. An IP address is often associated with the portal you used to enter the Internet, like your Internet Service Provider (ISP), company, association, or university. The information described in this paragraph, standing alone, cannot be used to determine your identity. Such information may, however, be combined in a way that makes it become personal- data (i.e., information that can identify you). For example, we may tie this information to personal data about you that we collect from other sources or that you provide to us. If this happens, we will treat the combined information as personal data. Additionally, where, according to local law, IP addresses and the like are considered personal data, we treat them as such.
The information we collect through technology on the Site helps us to improve the Site and to deliver more personalized service. The information enables us to estimate our audience size and usage patterns, allows us to customize our Website according to your individual interests, allows us to speed up your searches and allows us to recognize you when you return to the Site.
Do We Use Cookies?
Yes. Cookies are small pieces of data that the Site or our service provider transfers through your Web browser that enables the Site’s or service provider’s systems to recognize your browser and capture and remember certain information. We use cookies and other anonymous identifiers to help us understand how users use the Site. For example, cookies gather information about how long you spend on a web page so that we can understand what web pages are of most interest to users. Google Analytics
We use cookies provided by Google Analytics, a third-party service provider, to assist us in better understanding our Site visitors. These cookies collect data tied to a user’s IP address, such as the length of time a user spends on a page, the pages a user visits, and the websites a user visits before and after visiting the Site. Based on this information, Google Analytics compiles aggregate data about Site traffic and Site interactions, which we use to offer better Site experiences and tools in the future. Web Beacons
We include small graphic images or other web programming code, called web beacons (also known as "pixel tags", “web bugs” or "clear GIFs"), on the Site. The web beacons are minute graphics with a unique identifier. They are used to track the online movements of Web users. In contrast to cookies, which are stored in a user's computer hard drive, web beacons are embedded invisibly on Web pages and are about the size of the period at the end of this sentence.
Your ‘Do Not Track’ Browser Setting
We support the Do Not Track (DNT) browser setting. DNT is a preference you can set in your browser’s settings to let the websites you visit know that you do not want the websites collecting your data.
We may track your online activities over time and across third-party websites or online services. For example, we might use web beacons to help us determine what links or advertisers brought you to our Site. We then track your activities on our Site. We also may use web beacons to track your visits to other websites so that third-party service providers can display Bampooh advertisements to you on those other websites based on your activities while on the Site (“remarketing”). If you do not wish for us to track your online activities as described in this paragraph, you should enable the DNT setting for your browser. Our systems do not recognize "Do Not Track" signals, third party companies who utilize these cookies or beacons enable you to opt out of this behavioral advertising. Information Third Parties Provide About You
We may supplement the information we collect about you through the Site with records received from third parties. For example, the service provider that processes orders submitted through the Site shares your order information, but not payment information, with us.
Furthermore, our third-party email services providers, such as Constant Contact, may include - page tags (also known as web beacons) and other technologies in emails to you that allow the sender to collect information about who opened those emails, and to otherwise track your engagement with any links in the emails sent (for example, when you click a link).
In each case, the information we receive from third parties depends on the third party and that third party’s information collection and use policies. You should review the privacy policies and practices of third parties whose websites you visit or whose services you utilize, including in connection with our products or services.
Information You Provide to A Third Party
The Site includes links from the Site to, and plug-ins (such as Facebook and Twitter buttons) from, sites or applications operated by third parties (“Third-Party Sites”). Bampooh does not control any Third-Party Sites and is not responsible for any information they may collect. The information collection practices of a Third-Party Site are governed by their privacy policies. It is your choice to enter any Third-Party Site. We recommend that you read their privacy policies if you choose to do so.
CHILDREN’S ONLINE PRIVACY PROTECTION ACT COMPLIANCE
We do not knowingly collect any information from anyone under 13 years of age and you should not provide us with any information regarding any individual under the age of 13. The Site, and our products and services are intended to be accessed and used only by adults and are not directed to minors. If you are below the age of 18, you may access or use our Site only under the supervision of a parent or legal guardian who agrees to be bound by this Privacy Policy.

Data Retention
We retain your personal data collected via the Site for the duration of the customer relationship, if any, unless a specific retention period is required by applicable law. Job applications are purged if no action is taken, unless a specific retention period is required by applicable law.
HOW WE SHARE THE PERSONAL DATA WE COLLECT
We may sell, rent or share your personal data to third parties. The following are some of the ways we share your personal data:
Third-Party Service Providers: We will share your personal data with third-party service providers with whom Bampooh has agreements to help us provide services to you. The following are some examples of the types of third-party service providers with which we share your personal data and our purpose for doing so:
Data Analytics: We retain third-party service providers to help us perform data analytics regarding your interactions with the Site. For example, Google Analytics may track what pages users visit on the Site and how long they stay there to determine how users use the Site.
Legal Advice: We may disclose your personal data to an attorney in the process of obtaining legal advice.
Third-party Processors: Through the Site, you transmit your order and payment information to a third-party order and payment processor.
Advertising Platforms: We may disclose the fact that you visited the Site to advertising networks so that they can show you Bampooh advertisements on other websites and platforms. These services can help us tailor advertising that we think may be of interest to you based on your use of the Site and to otherwise collect and use data about your use of the Site.
Other Approved Vendors. We may share personal data with unaffiliated companies or individuals we hire to provide services or perform business functions on our behalf (such as print, mail, or email vendors; web hosting vendors; cloud service providers; consultants; digital advertising and analytics vendors; and contest or sweepstakes operators) because these vendors need access to the personal data to perform the functions we have requested of them. These vendors are contractually required to treat the personal data we provide as confidential, and to use the personal data only to provide the services we have requested they perform on our behalf.
Channel Partners: We may disclose your personal data related to your requests for information, quotes, and Bampooh products and services to our channel partners so that they can respond to your requests and offer local purchasing options and services.
Required Disclosures: We may be required to share personal data in a court proceeding, in response to a court order, subpoena, civil discovery request, other legal process, or as otherwise required by law.
Legal Compliance and Protections: We may disclose account and other personal data when we believe disclosure is necessary to comply with the law or to protect the rights, property, or safety of Bampooh, our users, or others. This includes exchanging personal data with other companies and organizations for fraud protection and credit risk reduction. We may also disclose personal data if requested by authorities in the event of any act or instance of local, regional, national or international emergency.
Corporate Transactions: We reserve the right to disclose and transfer your data, including your personal data:
To a subsequent owner, co-owner, or operator of the Site or successor database.
In connection with a corporate merger, consolidation, the sale of substantially all of our membership interests and/or assets or other corporate change, including to any prospective purchasers.

Also note that we may take your personal data and de-identify it either by combining it with information about others (for example, by aggregating it with information about other persons), and/or by removing characteristics (such as your name) that make the information personally identifiable to you. HOW WE PROTECT THE PERSONAL DATA WE COLLECT
The security and confidentiality of your personal data is important to us. We have certain technical, administrative, and physical security measures in place to protect your personal data from unauthorized access or disclosure and improper use.
For example, we use Transport Layer Security (TLS) encryption to protect the data collection forms on our Site. In addition, we restrict access to your personal data. Employees with access to personal data are kept up-to-date on our security and privacy practices.
It is important for you to protect against unauthorized access to your password and to your computer. Be sure to close your browser after you have completed your visit to the Site.
Please note that despite our efforts, no security measure is ever perfect or impenetrable, so we cannot guarantee the security of your personal data. YOUR CHOICES REGARDING YOUR PERSONAL DATA
- Managing Your Personal Data: You may contact hello@bampooh.com to access, update, correct, and delete your personal data. We may decline to process requests that jeopardize the privacy of others, are extremely impractical or would cause us to take any action that is not permissible under applicable laws. We will make all required updates and changes within the time specified by applicable law, and where permitted under applicable law, may charge an appropriate fee to cover the costs of responding to such request. Please remember, if you make such a request, we may not be able to provide you with the same quality and variety of products and services to which you are accustomed.
- Cookies: If you do not wish us to collect cookies, you may set your browser to refuse cookies, or to alert you when cookies are being sent. If you do so, please note that some or all parts of our Site may then be inaccessible or may not function properly.
- Communications: If you do not wish to receive notifications, text messages, alerts, posts, notices, emails or other communications from us or from third parties on our behalf, you can opt-out of receiving such communications from us through your account settings or, to the extent applicable, by using the unsubscribe process at the bottom of such communication or by emailing us at hello@bampooh.com. Please be aware that it can take up to 10 or more business days to remove you from our marketing lists. If you opt-out from receiving our marketing communications, you may continue to receive service-related communications, such as communications that are essential to your transactions on or through our Site.
- Online Behavioral Advertising: If you do not want to receive behavioral advertising, you should turn on the DNT feature in your browser. Additionally, certain third-party advertising networks that deliver behavioral advertising are members of the Network Advertising Initiative (“NAI”). You can prevent NAI member companies from collecting preference data about you by visiting http://www.networkadvertising.org/choices/ and following the NAI’s directions. Note that if you opt-out through the NAI, you will still receive advertising. INFORMATION SPECIFIC TO NON-U.S. USERS
We are headquartered in the United States of America. Personal information may be accessed by us or transferred to us in the United States or to our affiliates (including other members of the Bampooh corporate family including our office in the Netherlands), partners, merchants, or service providers elsewhere in the world. By providing us with personal information, you consent to this transfer.
All locations outside of the United States
The personal data collected through the Site is downloaded to a server maintained by Bampooh, LLC. Bampooh is located at 5725 Bagby Ave Suite #1, Waco, TX 76712 in the United States. Bampooh will comply with requests to exercise individual data rights in accordance with applicable law. You can contact hello@bampooh.com to request to exercise your data rights.
European Economic Area and Switzerland
The information in this section, as well as the information in the section above titled “All locations outside of the United States”, applies to users in the European Economic Area and Switzerland (collectively, the “EEA”).
Individuals in the EEA (“EEA Individuals”) are not required by statute or by contract to provide any personal data to the Site. Bampooh sometimes uses EEA Individuals’ personal data submitted through the Site for automated decision-making. For example, Bampooh may display advertisements and send emails to you containing content automatically chosen based on the products you have ordered from us in the past. However, Bampooh will not use EEA Individuals’ personal data submitted through the Site for automated decision-making, including profiling, which produces legal effects or similarly significantly affects the EEA Individual.
Cross-Border Data Transfers:
The personal data collected through the Site will be transferred to the United States. The recipients of personal data collected through the Site (listed in Section 3 above) are located in the United States or in the country where the data was collected. The European Commission has not issued a determination that the United States ensures an adequate level of protection for personal data.
Legal Bases for Processing:
Bampooh processes your personal data with your consent and as required by law. In addition, Bampooh processes your personal data as necessary for the performance of the sales contract, for example, when processing your orders and payments, and to take steps, at your request, before entering into a contract with you. For example, if you ask us for quotes for products and services you are interested in buying, we may send them to you. Bampooh also processes personal data as necessary for its legitimate interests as follows:
Marketing and advertising: Unless you opt-out as described below, we use your personal data regarding products and services you have ordered, or in which you have otherwise demonstrated an interest, as necessary to provide you with information about the products and services that we think might interest you in accordance with applicable law.
Network and information security, fraud prevention, and reporting suspected criminal acts: In the event of fraud, a security incident, or a suspected criminal act, we would examine personal data that appeared to be linked to the incident as necessary to determine what happened, remediate, report to the authorities, and prevent a recurrence.
Right to Object to Processing for Direct Marketing or Legitimate Interests:

Individual Rights:
EEA Individuals have the right to access their personal data collected by the Site and to request that Bampooh update, correct, or delete their personal data as provided by applicable law. EEA Individuals also have the right to object to or restrict, Bampooh's processing of their personal data.
In addition, EEA Individuals have the right to data portability concerning their personal data. Subject to certain limitations, the right to data portability allows EEA Individuals to obtain from Bampooh, or to ask Bampooh to send to a third party, a digital copy of the personal data that they provided to the Site. EEA Individuals’ right to access their personal data includes their right to receive a copy of all, or a portion, of their personal data in Bampooh’s possession as long as Bampooh's providing the personal data would not adversely affect the rights and freedoms of others.
EEA Individuals can exercise these rights by contacting hello@bampooh.com. Bampooh will respond to such requests in accordance with applicable data protection law. If EEA Individuals believe that their personal data has been processed in violation of applicable data protection law, they have the right to lodge a complaint with the relevant data protection authority in the country where they reside, where they work, or where the alleged violation occurred.
EEA Individuals may use the contact information above, at any time, to withdraw their consent for the processing of their personal data where Bampooh requires their consent as a legal basis for processing their personal data. Any withdrawal will apply only prospectively, and Bampooh will continue to retain the personal data that EEA Individuals provided before they withdrew their consent for as long as allowed or required by applicable law. To protect your privacy, we will take commercially reasonable steps to verify your identity before granting access to or making any changes to your Personal Data.
In addition, you may cancel or modify the email communications you have chosen to receive from Bampooh by following the instructions contained in our emails from us. Alternatively, you may email Bampooh at hello@bampooh.com with your request, stating ’Unsubscribe‘ in the header and which email addresses you wish not to receive Bampooh emails. Within a reasonable period, we shall ensure that such email addresses are unsubscribed.
CHANGES TO THIS PRIVACY POLICY
If we change this Privacy Policy, we will post those changes on this page and update the Privacy Policy modification date above. If we materially change this Privacy Policy in a way that affects how we use or disclose your personal data, we will provide a prominent notice of such changes and the effective date of the changes before making them.
